General Terms & Conditions
The General Terms and Conditions of Sale of FuelSearch shall apply exclusively. These terms shall be binding on FuelSearch and any Users of Products without an explicit written agreement to the contrary by both Parties. FuelSearch (hereinafter referred to as the “Facilitator”) is an online fuel-sourcing platform and payment gateway for petroleum products (hereinafter referred to as the “Product”) and provided by various Fuel Suppliers (hereinafter referred to as the “Supplier”) to Clients (hereinafter referred to as the “User”) The platform ensures that Users can obtain the best possible prices on petroleum
products. Users are guaranteed that the product will be delivered as the Facilitator will only release the funds to the nominated supplier on proof of delivery. We are not Fuel Traders or affiliated with any association, group or brand. FuelSearch only provides data to suppliers registered on this website to enable them to quote. A nominal surcharge will however be applicable depending on the quantities ordered.
FUEL GRADE AND QUALITY
The Client will be liable for and bear the risk of choice of Product grade and Quality the Facilitator will not be obliged to check whether the chosen Product grade is correct or be responsible for the quality control of the product. The transaction of buying fuel is between the User and Supplier and should there be any complaints, same must be resolved directly between the Supplier and the
User. It is also the buyers’ responsibility to test the fuel before taking delivery. If the buyer is unsatisfied with the product’s test result they have full right not to accept the load. If the buyer does not test and accept the load, ownership and responsibility of the load/product are transferred to the buyer. At FuelSearch, we urge clients to test the product before taking delivery.
DELIVERY
Upon delivery, the risk and title of the Product will pass concurrently at the passage of the fixed connections of the receiving storage equipment. Representatives from the receiving User will be responsible for ensuring the Product is received in a safe way and without any liability whatsoever to the Facilitator.
DISPUTES
The Facilitator is indemnified from any claims that may arise between the User and the Supplier.
QUANTITY
Complaints regarding differences in quantities will only be considered if the Seller is notified immediately and before the signing of Delivery Receipts. The Seller will only accept unsoiled and legible Delivery Receipts.The Facilitator will not accept any claim for short supply based on storage tank measurement inaccuracies. Should the Supplier deliver fewer products the Facilitator will refund the client the difference. It is the Supplier’s responsibility to ensure that the ordered quantities are correctly delivered. In the event of the oversupplying of the Product, it will be Supplier’s responsibility to collect the deficit in funds directly from the Client.
ON-ROAD
Upon vehicle registration, the system will generate an open purchase order of 1500L on behalf of the client on intervals of 1500L paid in intervals on completed on-road transactions.
REGISTRATION
By completing the FuelSearch application form you agree to all privacy, acceptable use and terms and conditions of the platform, company and partner companies. Restrictions You are specifically restricted from all of the following: publishing any Website material in any other media; selling, sublicensing and/or otherwise commercializing any Website material; publicly performing and/or showing any Website material; using this Website in any way that is or may be damaging to this Website; using this Website in any way that impacts user access to this Website; using this Website contrary to applicable laws and regulations, or in any way may cause harm to the Website, or to any person or business entity; FuelSearch Service Points In the event of the Applicant refuelling at FuelSearch Service Points, the Applicant hereby requests and authorizes FuelSearch to, on the Applicant’s behalf, procure the Applicant with diesel at these sites. The Applicant acknowledges and accepts that they will be charged a service and handling fee by FuelSearch for the provisions of stock procurement, stock management and the refuelling service for their vehicles. The Applicant furthermore hereby gives his/her consent and authorizes
FuelSearch to deduct from funds in the Applicant’s cash in an advance account, or linked credit facility, if available, and make payment on the Applicant’s behalf for bulk diesel stock purchases and service fees due by the Applicant at the applicable FuelSearch Service Points where these services were rendered.
Where the Applicant operates on a pre-paid account basis it is the Applicant’s responsibility to ensure: that there are sufficient funds available in the Applicant’s account for payment for services; that deposits are made to the nominated bank account as prescribed by FuelSearch from time to time; that deposits are made during normal working hours, 08h00 to 16h30 Monday to Friday, using the unique account reference number assigned to the Applicant so as to enable FuelSearch to identify and allocate the deposited funds without undue delay; that proof of payment is forwarded to FuelSearch for immediate processing of the deposit. The net amount of the deposit received from the Applicant will be credited to the Applicant’s pre-paid account. No interest will be paid in respect of credit balances in the Applicant’s pre-paid account. The following will apply where the Applicant pays for services by bank fleet card. Rebates due and payable to the Applicant for the calendar month will be electronically paid before the 7th of the next month. All fees and charges due to FuelSearch for services delivered in terms of this agreement shall be deducted from rebate amounts due and payable to the Applicant. The Applicant shall be responsible, payable immediately on demand, for the payment of any amounts due as a result of a card payment is rejected or not processed successfully, for whatever reason, or negligence by a service attendant to process the payment for a purchase, the result is that the amount is still due and outstanding by the Applicant.

By using this website the user consents to the jurisdiction of the courts of South Africa in respect of all disputes. FuelSearch shall be under no obligation to produce the original agreement for the purpose of any legal proceedings or any other purpose.
